Terms of Service

1. Introduction

The Chess Master Club (TCMC, we, us, or our) operates the website and service at thechessmasterclub.com (the Service). By accessing or using our Service, you agree to be bound by these Terms of Service. If you do not agree, please discontinue use immediately. These Terms apply to all visitors, users, and others who access or use the Service.

2. Eligibility

You must be at least 13 years of age to use the Service. By using the Service, you represent that you meet this age requirement. If you are between 13 and 18, you confirm that a parent or legal guardian has given permission. You are solely responsible for all activity under your account and for maintaining the confidentiality of your credentials. Notify us immediately at hello@thechessmasterclub.com of any unauthorized use of your account.

3. Account Registration

To access certain features, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep it up to date. You are responsible for safeguarding your password and must not share it with any third party. We reserve the right to suspend or terminate accounts that contain false information or that otherwise violate these Terms.

4. Subscription & Payments

The Service operates on a freemium model. The Italian Game opening is available at no cost. Additional chess openings may be purchased individually or as bundle packages at prices listed in our Store. All payments are processed securely by Stripe โ€” we do not store your payment card details on our servers. We offer a 7-day refund window for purchases where no drill session has been started. Once you begin drilling a purchased opening, the purchase becomes final and non-refundable. We may update prices at any time; changes do not affect existing purchases.

5. License to Use

Subject to your compliance with these Terms, TCMC grants you a limited, personal, non-exclusive, non-transferable, revocable license to access and use the Service for personal, non-commercial purposes only. You may not: (a) resell, sublicense, or redistribute access to any part of the Service; (b) use automated tools, bots, or scrapers to access or extract data; (c) reverse-engineer, decompile, or disassemble any component of the Service; (d) copy or create derivative works from our content without express written permission; or (e) use the Service for any commercial purpose without our prior written consent.

6. Intellectual Property

All content on the Service โ€” including chess opening databases, drill exercises, exam questions, training algorithms, graphics, text, logos, badges, and software โ€” is owned by or licensed to The Chess Master Club and protected by copyright, trademark, and other intellectual property laws. The name The Chess Master Club and the TCMC logo are trademarks of The Chess Master Club. These Terms do not transfer any intellectual property rights to you, nor grant any rights not expressly stated herein.

7. User-Generated Content

When you submit content to us โ€” including messages via contact forms, feedback, or suggestions โ€” you grant The Chess Master Club a worldwide, royalty-free, non-exclusive, perpetual license to use, reproduce, modify, publish, translate, distribute, and display such content in any medium. You represent and warrant that you own or have the right to grant this license and that your submissions do not infringe any third-party rights or applicable laws.

8. Prohibited Conduct

You agree not to: (a) attempt unauthorized access to any part of the Service or related systems; (b) probe, scan, or test the vulnerability of any TCMC system without authorization; (c) scrape or harvest user data or content without our express permission; (d) impersonate any person or entity, or misrepresent your affiliation with any organization; (e) transmit spam, malware, or any harmful, offensive, or unlawful content; (f) circumvent or disable any security or access control features; (g) interfere with or disrupt the proper functioning of the Service; or (h) violate any applicable local, national, or international law or regulation.

9. Termination

We reserve the right to suspend or permanently terminate your account at any time, with or without notice, if we reasonably believe you have violated these Terms or that continued access poses a risk to TCMC or other users. You may delete your account at any time through your Account Settings page or by contacting us at hello@thechessmasterclub.com. Upon termination, your license to use the Service ceases immediately. Provisions that by their nature should survive termination โ€” including intellectual property, disclaimer of warranties, and limitation of liability โ€” shall continue to apply.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN AS-IS AND AS-AVAILABLE BASIS WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TCMC DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. TCMC DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, OR THAT ANY DEFECTS WILL BE CORRECTED. YOUR USE OF THE SERVICE IS ENTIRELY AT YOUR OWN RISK.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TCMC AND ITS DIRECTORS, EMPLOYEES, PARTNERS, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE. TCMCโ€™S TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS SHALL NOT EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT YOU PAID TO TCMC IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) EUR 100.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the European Union and, where applicable, the laws of France, without regard to conflict of law principles. Any disputes arising from or relating to these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the competent courts of France, unless mandatory consumer protection laws in your country of residence require otherwise. Nothing in this section limits your statutory rights under applicable consumer protection legislation.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page with a revised date and, where appropriate, by email notification to registered users. Your continued use of the Service after such changes constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the Service and may delete your account.
